Our group follows issues that matter to Dunwoody residents. This letter was sent to city leaders on Dec 12, 2010:
Hi Brian, Warren and Mayor Wright:
If I can attend Monday's city council meeting, I am going to ask that the city's resolution supporting the GA Music Hall of Fame move to Dunwoody be declared void. The proposed resolution was not presented to council in writing. It was created orally, by Councilman Wittenstein, with only our clerk writing it down (after it was introduced). Though council made a point to appear to follow the rules by amending the agenda for the inclusion of this item - it failed to adequately do what is fully required. Our code is very clear for the legal process that should occur:
Article II, Sec. 2.15, A: "Every proposed ordinance and resolution shall be introduced in writing..."
Furthermore, as evidence of the proposal not being written down, the city's clerk was unable to read the full resolution aloud before the vote, as she had not completed creating a draft of the resolution for the city's records. A vote was taken on, as one councilman said, a “gist” of what should have been written. I wanted to make you aware of the legal problem with this resolution. If I am not able to speak at the meeting on Monday, I hope you will address this and do what is legally and ethically correct for our city. I think the citizens of Dunwoody deserve trustworthy leadership. You can correct this mistake and I look forward to you doing so.
